Patient voluntarily dismisses suit alleging breast implants migrated four times

Madison County Circuit Judge William Mudge granted voluntary dismissal in a lawsuit alleging a cancer patient's breast implants migrated multiple times after four surgeries.

On Sept. 8, plaintiff Eileen and Richard Dawdy filed a motion to voluntarily dismiss defendant Hania Bednarski, individually and doing business as Serenity Surgery.

Mudge granted dismissal without prejudice on Sept. 19.

The Dawdys filed the complaint on June 14, alleging Bednarski failed to properly perform the breast implant surgery after Eileen Dawdy’s battle with cancer.

According to the complaint, the Dawdys allege that over the course of 2014 and 2015, Eileen Dawdy underwent four surgeries performed by Bednarski. She claims the breast implants migrated after each surgery.

The plaintiffs allege the defendant failed to use tissue expanders in order for the breast implants to remain in the correct position.

They seek judgment in an amount in excess of $50,000, plus court costs.

The Dawdys are represented by Matthew Chapman of Becker Schroader & Chapman in Granite City.
