Motorist blames St. Clair County driver for causing crash

BELLEVILLE — An O'Fallon man is suing a St. Clair County motorist, alleging the defendant's negligence led to a crash that injured the plaintiff. 

Bert Erick Hodges filed a lawsuit Aug. 4 in St. Clair County Circuit Court against Jay J. Lingelbach, alleging violation of the Illinois Vehicle Code.

According to the complaint, on May 11, 2015, Hodges was traveling westbound on Interstate Highway 64, approaching milepost 13 in St. Clair County. The suit says Lingelbach, who was traveling behind Hodges, rear-ended the plaintiff's vehicle. The crash caused Hodges to sustain neck pain, chest pain and abdominal pain, the lawsuit states. 

The plaintiff alleges Lingelbach failed to reduce speed, failed to keep careful lookout, failed to yield right of way and failed to properly operate his vehicle as not to endanger the safety of others.

Hodges seeks trial by jury, judgment of more than $50,000, plus costs of suit. He is represented by attorney James W. Eason of The Eason Law Firm in St. Louis.
