Customer sues J.C. Penney over trip and fall

BELLEVILLE — A St. Clair County woman is suing J. C. Penney, alleging she fell while walking in the store and suffered injuries. 

Susan L. Triplett filed a lawsuit July 28 in St. Clair County Circuit Court against J. C. Penney Properties Inc. alleging negligence in failing to maintain its store in a safe and proper manner.

According to the complaint, on Aug. 28, 2014, Triplett was a customer walking in the J. C. Penney store in St. Clair's Square in Fairview Heights when she tripped and fell. The suit says the fall caused Triplett to sustain injuries to her back, shoulder, neck and hip that necessitated large sum of monies for medical treatment. 

The plaintiff alleges the defendant permitted and allowed a raised piece on the floor and failed to provide a flat surface for customers to walk on.

Triplett seeks a trial by jury, judgment of more than $50,000, plus costs of suit. She is represented by attorney Bob L. Perica of The Perica Law Firm PC in Wood River.
