Motorist sues tractor trailer owner, driver following crash

EDWARDSVILLE — A motorist is suing a tractor trailer owner and driver, alleging their negligence caused a crash that injured the plaintiff.

Emmett D. McKenzie filed a lawsuit July 26 in Madison County Circuit Court against RTS Holdings LLC and Darryl Lamonte Foney, alleging Foney carelessly operated the tractor trailer.

According to the complaint, on June 21, McKenzie was driving a jeep, eastbound on Interstate Highway 270, when Foney drove his tractor trailer from the left lane of travel into the right lane of traffic and collided with the plaintiff's jeep.

The suit says the crashed caused McKenzie to sustain injuries leading to pain, disability, lost wages and medical expenses. The plaintiff alleges Foney failed to keep proper lookout and failed to timely stop the vehicle. The suit says Foney was working for RTS Holdings at the time of the crash.

McKenzie seeks a trial by jury, judgment of more than $50,000 and legal costs. He is represented by attorney Brad L. Badgley of Belleville.
