Delivery man blames property owner for injuries

BELLEVILLE — A Kentucky man is suing an Alorton property owner, alleging the defendant's negligence caused the plaintiff to sustain injuries in a fall.

Michael Duncan filed a lawsuit July 12 in St. Clair County Circuit Court against Solva Y Fluorides Inc., alleging negligence in failing to maintain a safe premises.

According to the complaint, on Sept. 17, 2014, while Duncan was delivering goods on the defendant's property at 3500 Missouri Ave., Alorton, an uneven surface caused the plaintiff to fall. The suit says this fall resulted in Duncan's physical disability, disfigurement, loss of normal life, wage loss, impairment of earning capacity and incurred medical expenses. 

The plaintiff alleges the defendant failed to maintain its premises in a safe condition, failed to provide a safe dock for deliveries and failed to inspect the premises to ensure unloading/loading area were available for use.

Duncan seeks a trial by jury, judgment of more than $50,000, costs of suit and any additional relief the court deems necessary. He is represented by attorneys J. Michael Weilmuenster and Thomas Zurliene of Weilmuenster and Keck PC in Belleville.
