Consumer alleges creditor violated federal law

EDWARDSVILLE — A Madison County man is suing an Illinois collection agency, alleging he received harassing phone calls about a debt that did not exist. 

Geoff G. Heusohn filed a lawsuit June 24 in Madison County Circuit Court against Portfolio Recovery Associates LLC alleging violation of the Fair Debt Collection Practices Act and the Telephone Consumer Protection Act.

According to the complaint, within the last 12 months, Heushon has received numerous harassing phone calls about an alleged debt that he did not owe and without his prior express permission. 

The plaintiff alleges Portfolio Recovery placed calls using an automatic telephone dialing system and/or a pre-recorded or artificial voice messages and even continued to do so even after he notified them that the alleged debt resulted from identity theft.

Heushon seeks a trial by jury, statutory damages of $1,000, treble damages of $1,500 per call, actual damages, pre-judgment and post-judgment interest, punitive damages, attorney fees and legal costs and such other relief as the court deems just. He is represented by attorney Andrew J, Fieldman of Edwardsville.
