EDWARDSVILLE — A Madison County widower is suing a motorist, alleging his negligence led to a car crash that killed the plaintiff's wife.
Edwin Charles Twesten II, as surviving spouse of Elaine M. Twesten filed a lawsuit June 15 in Madison County Circuit Court against Blake Johnson, alleging violation of Illinois' Wrongful Death Act.
According to the complaint, on Oct. 14, 2014, Elaine M. Twesten was driving a car exiting the Sunset Hills Professional Park parking lot and turned left onto Northbound South state Route 157. The suit says Johnson's vehicle overtook Twesten's vehicle in the right lane and crashed into her car causing extreme property damage and killing Twesten.
As a result of his wife's death, the complaint says, the plaintiff has suffered loss of service, society, companionship, comfort, counsel and the support of his spouse. He alleges Johnson failed to yield right of way, failed to keep proper lookout, failed to operate his vehicle properly and failed to avoid the collision.
Edwin Chasten seeks trial by jury, judgment of more than $50,000, legal costs and expenses and any further relief the court deems proper. He is represented by attorney Benjamin J. Sansone of Sansone & Lauber in Clayton, Missouri.
