EDWARDSVILLE — A Waterloo man is suing Barnett Outdoors LLC and Waterloo Rural King Supply Inc., a crossbow manufacturer and retail store, citing alleged negligence, breach of implied warranty and fraudulent misrepresentation.
Fred Schmidt filed a complaint on June 13 in Madison County Circuit Court against the defendants, alleging that they failed to comply with the Illinois Consumer Fraud Act.
According to the complaint, the plaintiff alleges that, on Jan. 15, 2014, in the process of firing a crossbow, he sustained severe personal injury to his left thumb, resulting in disfigurement, physical pain and suffering, mental anguish, loss of earnings and medical expenses. The plaintiff holds Barnett Outdoors LLC and Waterloo Rural King Supply Inc. responsible because the defendants allegedly negligently designed, manufactured, distributed and sold the defective crossbow and refused to recall the crossbow it knew to be defectively designed.
The plaintiff requests a trial by jury and seeks judgment against defendants in an amount in excess of $50,000, plus costs of suit and attorney's fees,. He is represented by Jason D. Johnson of Hepler Broom LLC in Edwardsville.
