Granite City collision case at trial in Judge Stobbs’ courtroom

A car accident lawsuit involving a Granite City collision is at trial in Madison County Associate Judge Stephen Stobbs’ courtroom this week.

The trial began on May 2.

Plaintiff Anthony J. Viviano is represented by W. Michael Gnavi of Gnavi Law Offices in Collinsville in the trial.

Defendant Gregory M. Rogers is represented by Jason Kleindorfer of Freeark Harvey & Mendillo in Belleville.

Viviano filed his complaint on April 14, 2015.

In his complaint, Viviano claims he was operating his vehicle westbound on 23rd Street on Dec. 18, 2013, when he stopped at a stop sign at the intersection of Washington Avenue in Granite City.

At the same time and place, Rogers was also driving his vehicle westbound on 23rd Street directly behind Viviano when he allegedly rear-ended the plaintiff.

Viviano alleges Rogers negligently failed to keep a proper lookout for other vehicles, failed to apply his brakes to avoid contact with the rear of the plaintiff’s vehicle, operated his vehicle at a speed greater than the speed limit, drove too fast for conditions and operated his vehicle in a careless manner.

As a result, Viviano claims he suffered injuries to his left shoulder, left arm and neck.

Rogers denied liability and claims the plaintiff’s own negligence was the sole proximate cause of his alleged injuries.
