Belleclair Fairgrounds Park denies liability in man’s suit alleging collapsed chair

The Belleclair Fairgrounds Park claims a man caused his own injuries when his chair allegedly collapsed.

Jack Lutz filed the lawsuit on Oct. 19 against Belleclair Fairgrounds Park in Belleville.

According to the complaint, the fairgrounds park is rented to groups for flea markets and antique shows. On July 20, 2014, Lutz claims he was displaying antiques in a booth he rented, which included a table and chair. While sitting in the provided chair, he alleges it collapsed beneath him, causing him to fall to the floor.

As a result, he claims he injured his head, body, limbs and spine.

Belleclair Fairgrounds Park answered the complaint on Dec. 29 through attorney Benjamin Powell of HeplerBroom in Edwardsville.

The defendant argues that the plaintiff’s alleged injuries were caused by his own negligence.

Lutz replied to the affirmative defenses on Jan. 11 through attorney Thomas Kemper of Butler & Kemper in Granite City. He denies the allegations against him and claims the defendant’s negligence is the sole cause of his alleged injuries.

He seeks damages of more than $50,000, plus court costs and attorney’s fees.
