Highway collision results in lawsuit

EDWARDSVILLE – A Madison County man is suing the driver of a vehicle after he was allegedly injured in a traffic accident on Interstate 270. 

Kevin S. Dunn filed the suit on Jan. 8 in Madison County Circuit Court against Joshua W. Weiss, citing negligence. 

Dunn and Weiss were both driving west on U.S. 270 in Madison County on March 5, 2015 when Weiss' vehicle allegedly hit Dunn's car from behind. The suit alleges the defendant was driving at an imprudent speed, and failed to keep his vehicle under control, reduce his speed to avoid a collision, and keep a safe distance between his vehicle and the plaintiff's.

As a result of the defendant's negligence, the suit alleges the plaintiff was injured both internally and externally, has suffered and will suffer great pain, and has spent and will continue to spend money seeking medical care and pharmaceuticals to treat his injuries. He also allegedly has lost wages and his future earning capacity has been damaged.

The plaintiff seeks at least $50,000 plus court costs and attorney fees. He is represented by Steven Giacoletto of Giacoletto Law Firm in Collinsville, Illinois.
