Belleville gas station removes customer’s slip and fall suit

The owners of a Belleville gas station removed a woman’s slip and fall suit that alleges she slipped on ice while standing at the gas pump.

The defendants filed a notice of removal to the U.S. District Court for the Southern District of Illinois on Nov. 18 through attorney Beth Boggs of Boggs, Avellino, Lach & Boggs in St. Louis.

They argue that removal is proper based on diversity of citizenship and the amount in controversy.

Sharon and Jay Hoffman filed the lawsuit on Oct. 19 against Supervalue Holdings Inc. and Shop ‘N Save Warehouse Foods Inc.

According to the complaint, Sharon Hoffman slipped and fell on an unnatural accumulation of ice located below a permanent overhead canopy while she was a patron at the Shop ‘N Save Fuel Express in Belleville on Jan. 22, 2014.

The plaintiffs allege the defendants should have discovered or warned her of the problem.

They seek damages in excess of $75,000, plus court costs.

The plaintiffs are represented by Matthew Young of Kuehn, Beasley & Young in Belleville.
