Missouri woman sues Food Mart over slip and fall

A Missouri woman is suing the owner of a Madison County convenience store, alleging negligence after she slipped and fell on water in the store.

Julie J. Burgess filed a complaint on Sept. 22 in Madison County Circuit Court against Wade Development Corp., doing business as a CC Food Mart, alleging negligence.

On Sept. 24, 2013, the complaint states, Burgess entered the CC Food Mart in Madison County to purchase beverages. She walked to the cooler area, took beverages from the cooler, and, as she was walking to the checkout counter, slipped and fell on water on the floor, causing injuries to her right knee and shoulders, the suit says.

The lawsuit alleges the defendant was negligent in failing to warn of the presence of a slick condition on the floor. As a result, the suit says, Burgess has incurred approximately $70,000 in medical expenses, and has sustained loss of mobility, pain and suffering, mental anguish and loss of enjoyment of life.

Burgess seeks more than $50,000, plus costs of the suit. She is represented by attorney Julia M. Kerr of Brown & Crouppen in St. Louis.
