An Alton doctor and medical practice deny liability and seek to dismiss a patient’s lawsuit alleging infected sutures caused her bowels to drop.
Kristi Nasello filed the March 3 lawsuit against Alton Multispecialists Ltd., OSF Healthcare System, St. Anthony’s Healthsystem, Dr. Catherine L. Wikoff and Dr. Tim C. Kisabeth.
According to the complaint, the doctors determined during a follow-up examination that the sutures in the fatty tissue around Nasello’s bowels caused a severe infection. As a result, Nasello’s bowels, bladder and intestines dropped, the suit states.
Wikoff and Alton Multispecialists denied liability in their Sept. 18 answer to the complaint through attorneys Jeffrey Glass and Untress Quinn of Hinshaw & Culbertson in Belleville.
The defendants also filed a motion to dismiss Counts I and III of the complaint on June 23. They argue that the plaintiff failed to comply with statutory requirements by failing to file an attorney affidavit.
In a July 24 order, Circuit Judge Barbara Crowder denied the motion to dismiss and gave the plaintiff time to file the attorney affidavit.
OSF Healthcare System filed a motion to dismiss Count II of the complaint on July 6 through attorneys Edward Bott Jr. and Mary Taylor of Greensfelder, Hemker & Gale in St. Louis. The defendant argues that the count is directed towards Saint Anthony’s Health System, which dissolved in November 2014. OSF Healthcare System is the successor-in-interest of Saint Anthony’s Health System, and has acquired its assets and liabilities.
OSF Healthcare System also answered the complaint on July 6, arguing that the alleged injuries were not caused by any act or omission of the defendant or its employees.
Kisabeth previously denied the allegations against him, claiming the alleged injuries were the result of “some conduct other than this defendant’s conduct, which conduct was the sole proximate cause of plaintiff’s alleged injuries or damages.”
Nasello seeks more than $250,000 in damages, plus costs.
