St. Clair County alleges injuries after he tripped in NAPA Auto Parts parking lot

A St. Clair County man claims he injured himself when he allegedly tripped over a concrete impediment in the parking lot at NAPA Auto Parts in Sparta.

Douglas K. Rushing and Patricia Rushing filed a lawsuit on July 31 in St. Clair County Circuit Court against Sparta Equipment Sales & Service, Inc., alleging negligence.

According to the complaint, on Aug. 2, 2013, Douglas Rushing was injured after tripping over a concrete impediment in the parking lot of a Sparta NAPA Auto Parts business operated by Sparta Equipment Sales & Service.

As a result, Douglas Rushing claims he injured his right shoulder, both wrists, and his left knee and developed rhabdomyolysis. The complaint alleges Rushing sustained pain and suffering, disability, loss of enjoyment of life, and incurred and will incur medical expenses, all damages exceeding $50,000.

The complaint alleges the defendant was negligent in its failure to paint the impediment to warn customers.

The Rushings seek damages of more than $50,000, plus costs of the suit. They are represented by attorney Michael L. McGlynn of McGlynn & McGlynn in Belleville.
