Customer sues O'Fallon restaurant for injuires from fall

A St. Clair County woman is suing the O'Fallon Texas Roadhouse, alleging she suffered injuries after she tripped over a raised rug while leaving the restaurant.

Elizabeth Beliveau filed a lawsuit on Aug. 4 in St. Clair County Circuit Court against Texas Roadhouse of O'Fallon, alleging negligence.

According to the complaint, on July 1, Beliveau was leaving the Texas Roadhouse, at 1412 Central Park Circle, O'Fallon, when a "raised and uneven rug caused her to fall and strike her head on a door jamb, causing her severe and permanent injuries to her head and body."

The suit says the defendant was negligent for failing to provide a safe entrance and exit, remove or fix the rug, properly inspect the premises, warn customers about the tripping accident, and make the entrance and exit safe for passage.

As a result, the plaintiff sustained not only injuries but pain and suffering and medical expenses, the complaint states.

Beliveau seeks damages of more than $50,000, plus costs. She is represented by attorneys John T. Hipskind and Brady M. McAninch of Hipskind and McAninch in Belleville.

St. Clair County Court case number 15-L-441.
