A Walnut Hill man is leading a class action suit against Lumber Liquidators for allegedly selling him and others a brand of Dura-Wood flooring he claims is defective.
Kevin Morris and others filed a class-action complaint on Aug. 18 in St. Clair County Circuit Court against Lumber Liquidators Inc.
According to the complaint, in February 2013, Morris bought 900 square feet of the Casa de Colour Collection by Dura-Wood, which is a pre-finished and stained hardwood flooring.
About six months after spending about $5,000 and 24 hours installing the flooring, Morris, who claims to be a skilled installer, started noticing defects in the flooring -- specifically, warping, buckling and cupping, the suit states.
The plaintiffs, citing common law fraud, breach of implied warranty, breach of express warranty and violations of the state Uniform Deceptive Trade Practices Act and state Consumer Fraud and Deceptive Business Practices Act, ask the court to declare this case a class-action, to refund Morris and any other class members their money and installation costs, injunctive relief, court costs and attorneys' fees.
The plaintiffs are represented by James G. Onder and William W. Blair of Onder, Shelton, O'Leary and Peterson LLC in St. Louis.
