Madison County heating business sues construction company, alleging failure to pay

A Madison County HVAC business is suing a Minnesota construction company, alleging failure to pay for work performed.

Elm Sheet Metal Heating and Air Conditioning Inc. filed a lawsuit on Aug. 13 in Madison County Circuit Court against Sand Construction and Sand Companies Inc., of Waite Park, Minn.

According to the complaint, on April 23, 2013, the plaintiff's president, Ernie Morris, entered into a contract with Sand Construction to do heating and air conditioning work on a new Country Inn and Suites at Prehn Plaza in Springfield. The suit says Elm Sheet Metal has done all the work satisfactorily, but has yet to be paid for the work, as well as extra work, which amounts to $57,272.

Elm Sheet Metal Heating and Air Conditioning seeks payment in full, plus legal costs.

It is represented by attorney Ronald A. Roth of the Roth Law Offices in Granite City.
