Couple sues window company over alleged water damage

A couple claims their windows were installed incorrectly, allegedly causing water damage.

Timothy and Terri L. Schmidt filed a complaint on July 22 in Madison County Circuit Court against Window World of St. Louis Inc.

On May 25, 2010, the plaintiffs claim they paid the defendant to install windows on July 6 at their residence. On June 19, 2014, the Schmidt's allegedly removed carpeting to install hardwood flooring and found water damage under the carpeting along the exterior walls, revealing that the windows were installed in correctly, the suit states.

On Sept. 9, 2014, the defendant allegedly admitted that the windows weren't installed correctly, according to the complaint.

The plaintiffs, citing breach of contract, breach of contract and negligence, seeks damages of more than $150,000, plus costs.

The plaintiff is represented by Bradley C. Allen of McCarthy and Allen in Edwardsville.
