An apartment complex removed a case to federal court that alleges a man was injured when a faulty balcony railing allegedly caused him to fall.
Willow Park Apartments filed a notice of removal to the U.S. District Court for the Southern District of Illinois on July 9. The defendant argues that removal is proper based on diversity of citizenship and the amount in controversy.
According to John Zanger’s May 18 lawsuit, he claims he was at the apartments on May 3, 2015, at 1241 Roger Ave. in Swansea when he allegedly fell.
The defendant is accused of failing to provide a safe balcony railing, maintain the railings and warn visitors of a dangerous condition.
As a result, Zanger claims he suffered injuries to his spine, head, left leg and left shoulder.
The plaintiff seeks damages in excess of $200,000, plus costs.
