A customer is suing after he claims he was injured when he tripped over a lumber cart at the Granite City Lowe's.
Phil L. Larose, of Granite City, filed a lawsuit on June 26 in Madison County Circuit Court against Lowe's Home Centers, alleging negligence and premises liability.
According to the complaint, on July 1, 2013, Larose was shopping at the Granite City Lowe's in the lumber section when he claims he hit then tripped over a lumber cart, causing him injury, pain and suffering, loss of a normal life and medical expenses.
The suit says Lowe's was negligent for failing to warn Larose of an unsafe condition, inspect the lumber section for hazards, operate the cart in a safe way, placing the cart in Larose's path, leaving a cart where it wasn't sufficiently noticeable, remove the cart from the aisle and fix the hazardous condition.
Larose seeks damages of more than $100,000, plus legal costs. He is represented by attorney John T. Papa of Callis, Papa and Szewczyk in Granite City.
