Pharmacy, pharmacist seek to dismiss suit over alleged wrong prescription

A pharmacy and pharmacist are seeking to dismiss a woman’s lawsuit alleging she suffered injuries when she was given the wrong prescription.

Patricia Pressman filed her lawsuit on April 6 against Hideg Pharmacy Inc. and Donald Johnston.

According to the complaint, Pressman was prescribed hydralazine on April 24, 2014, which she allegedly took that same day. The plaintiff claims the wrong medication “caused harm and illness to [Pressman], which resulted in subsequent hospitalization.”

Pressman alleges bodily injury, pain and suffering, disability, mental anguish, loss of capacity and medical expenses.

The plaintiff seeks damages exceeding $100,000, plus costs.

The defendants filed a motion to dismiss the complaint on May 5, arguing that no attorney affidavit was provided as required.

St. Clair County Circuit Judge Andrew Gleeson scheduled a motion hearing to address the motion to dismiss on July 29 at 9 a.m.

Pressman is represented by Dominic Kujawa of Belleville. 

The defendants are represented by Kenneth M. Burke and David P. Ellington of Brown & James in St. Louis.
