Man sues owner of Fairview Heights' Domino's claiming he tripped on spherical object

 

A man blames the owners of a Fairview Heights pizza restaurant’s parking lot for causing his fall over a “spherical object.”

Bradley Van Hoose filed a lawsuit Dec. 11 in St. Clair County Circuit Court against MBR, MBR Management Corp. doing business as Domino’s Pizza and Jemontae L. Tomlinson.

In his complaint, Van Hoose alleges he was visiting the Domino’s at 5519 North Illinois in Fairview Heights on Dec. 12, 2010, when he fell over a “spherical object” in the restaurant’s parking lot.

Because of his fall, Van Hoose sustained severe injuries, was hindered from attending to his usual duties and suffered great pain and anguish, according to the complaint. He also incurred medical costs, the suit states.

Van Hoose blames the defendants for causing his fall, saying they negligently failed to properly construct the parking lot, failed to keep the parking lot safe, failed to inspect the parking lot to make sure it was safe, allowed the parking lot to remain in a dangerous condition, created a hazardous condition by placing spherical objects on the parking lot and failed to fix the dangerous condition on the parking lot.

In his three-count complaint, Van Hoose is seeking a judgment of more than $150,000, plus costs.
