Failure to yield at stop sign prompts suit



Two years after a collision in which a man allegedly failed to yield at a stop sign, a driver seeks more than $50,000 for damages he says he sustained in the accident.

Lucian Dennis Frazier filed a lawsuit Dec. 10 in Madison County Circuit Court against Damon Muscarella.

In his complaint, Frazier claims he drove a 2003 Dodge Ram Quad 2500 truck west on College/Route 140 in Madison County. At the same time, Muscarella was driving a Chevrolet truck south on Worden Street when he failed to yield at a stop sign, according to the complaint. In turn, he struck Frazier’s vehicle, the suit states.

Because of the collision, Frazier experienced pain and suffering and lost wages, the complaint says.

Frazier blames Muscarella for causing the collision, saying he negligently failed to keep his vehicle under proper control, failed to stop or slow to avoid a collision and failed to keep a proper lookout.
