Old Republic sues Truck Centers in Troy over driver's icy slip and fall



A commercial truck dealership in Troy is being sued after a driver allegedly slipped and fell on ice on the company's property.

Old Republic Life Insurance Co., as subrogee of KLLM Transport Services LLC, as subrogee of Lonnie Chappell, filed a lawsuit Dec. 14 in Madison County Circuit Court against Truck Centers Inc.

Chappell worked as a driver for KLLM Transport in December 2010 and drove a tractor trailer to the Formosa Road Truck Centers for service, according to the complaint. Upon arrival at the dealership, Chappell says he was told by a KLLM Transport employee to park his truck in the lot across from the entrance to the building.

After parking where he was instructed, Chappell says he stepped out of his truck and slipped on ice and snow that had accumulated in the lot. Chappell, who claims he was hurt in the incident, was covered at the time by KLLM's insurance provider, Old Republic Life Insurance.

Old Republic accuses Truck Centers of negligence and asks for more than $50,000 in damages to cover the costs of Chappell's injuries and court fees.

The insurance company is represented by attorneys Donald W. Devitt and James M. Magiera of Chicago.
