Madison County Circuit Judge Andreas Matoesian on Friday allowed Swansea trial attorney and newly elected Fifth District Appellate Judge Judy Cates’ motion to withdraw as plaintiff attorney in a lawsuit against a Roxana landlord for alleged negligence and wrongful death.
Cates requested to withdraw from the case as lead counsel Dec. 3, the day she was sworn into office. Ryan Mahoney, an attorney at The Cates Law Firm, will be substituted as the new lead counsel.
The lawsuit involves plaintiffs Tiffany Gresham and Toni Leeds, special administrator of the estate of Skye Nichole Gresham, and Jason Matthew Gresham II, who sued Dawson M. Cooper on April 9 in Madison County Circuit Court over a fatal apartment fire.
