The relatives of a recently deceased woman have filed suit against the allegedly intoxicated driver who they claim struck the mother of four and killed her.
Dawn Ballion, Monty Rapp Jr., Crystal Loepker and Vera Davis claim their mother, Geraldine Davis, was riding in a vehicle Vera Davis was driving on Interstate 270 on Oct. 20 when defendant Travis King, who was driving in the same direction, struck the back of Vera Davis’s vehicle.
Because of the collision, Geraldine Davis died at the scene of the accident while Vera Davis suffered shoulder, face, head, neck, chest, back, neck and right knee injuries, according to the complaint filed Nov. 19 in Madison County Circuit Court. In addition to her injuries, Vera Davis also incurred medical costs while Geraldine Davis’s family incurred funeral costs of $4,650.30, the suit states.
King negligently drove too fast, failed to keep a proper lookout, failed to warn of his impending approach, failed to stop, failed to yield the right-of-way and drove while intoxicated, the complaint says.
In addition to King, the plaintiffs name Mega Leasing Corporation doing business as Pop’s Nightclub and Concert Venue and Wild Inc. doing business as Wild Country as defendants. The two businesses had served King alcohol before the collision, according to the complaint.
In her complaint, Geraldine Davis is seeking a judgment of more than $150,000, plus costs.
