Motorized cart incident at Cahokia Wal-Mart leads to suit



A St. Clair County woman has filed suit against Wal-Mart after she claims a motorized cart struck her.

Edna F. Allen claims she was visiting Wal-Mart at 1511 Camp Jackson Road in Cahokia on Nov. 1, 2010, when she was struck by the motorized cart.

Because of the incident, Allen sustained left elbow, right hip, neck and back injuries; sustained serious pain and suffering; and incurred medical costs, according to the complaint filed Oct. 29 in St. Clair County Circuit Court.

Wal-Mart employees negligently owned a motorized cart that they knew presented a danger to others, authorized a person to operate the motorized cart who was not qualified to do so, failed to take appropriate measures to train people who were operating the motorized cart and failed to warn customers of the use of the motorized cart, the suit states.

In her complaint, Allen is seeking a judgment of more than $50,000, plus costs.

She will be represented by Brian S. McChesney and Craig M. Ortwerth of McChesney and Ortwerth in St. Louis.
