Passenger in SWIC-owned van sues over accident injuries

A man has filed suit against the drivers who he claims caused a collision at an intersection.

Kevin Boyd claims he was riding in a van owned by defendants Southwestern Illinois College and the Board of Trustees of Community College District No. 522 that defendant Carl Dominick was driving east on Vieux Carre near its intersection with Illinois Route 157 on Oct. 30, 2010, when the collision occurred. Suddenly, defendant Colby B. Adams crashed into the van, according to the complaint filed Oct. 23 in St. Clair County Circuit Court.

Because of the collision, Boyd suffered great physical pain and mental anguish, incurred medical costs and lost wages, the suit states. He also suffered an impaired earning capacity, the complaint says.

Boyd blames Adams for causing the collision, saying he negligently failed to keep a proper lookout, failed to keep his vehicle under control, drove too fast and failed to swerve in time to avoid a collision.

Dominick negligently failed to keep a proper lookout, failed to keep his vehicle under proper control and failed to swerve in time to avoid the collision, according to the complaint.

In his three-count complaint, Boyd is seeking a judgment of more than $150,000, plus costs.

David H. Bone of Kassly, Bone and English in Belleville will be representing him.

St. Clair County Circuit Court case number: 12-L-566.
