Customer claims manager laughed at her after slip and fall

A woman has filed suit against the convenience store where she claims an assistant manager laughed at her after she fell on liquid spilled on the floor.

Alayna Counsell claims she was filling up her soda cups at Mac’s Convenience Stores doing business as Circle K. Convenience Store on Aug. 5 when she slipped on a wet floor.

“As the plaintiff lay on the floor, the defendant’s assistant manager looked at the plaintiff and laughed,” the suit states.

Because of her fall, Counsell sustained serious injuries to her neck, back and knee; experienced pain and suffering; and was prevented from attending to her usual duties and affairs, the complaint says. She also claims she lost income and incurred medical costs.

The Circle K Convenience Store, which is located at 8300 Old St. Louis Road, negligently maintained its store’s floor in such a manner as to allow water to create a slippery surface, allowed water to remain on the floor after mopping, failed to inspect the floor to make sure it was safe and failed to warn its invitees of the wet condition on the floor, according to the complaint.

In her complaint, Counsell is seeking a judgment of more than $50,000, plus costs.
