A woman claims an insurance company refuses to pay her for more than $50,000 in medical costs she incurred in a collision.
Rita Akers filed a lawsuit Oct. 5 in Madison County Circuit Court against Allstate Fire and Casualty Insurance Company.
In her complaint, Akers alleges she was involved in a collision with an uninsured driver, Jessica S. Dewey, in Alton on Feb. 16, 2011. At the time of the collision, Akers had an insurance policy through Allstate, which was supposed to cover her in case she got into a collision with an uninsured driver, according to the complaint.
Following the collision, Akers asked the insurance company to pay for her more than $50,000 worth of medical costs, the suit states.
However, Allstate refused to do so, the complaint says.
In her complaint, Akers seeks an order declaring that Allstate waive the arbitration provisions in the policy and allow Akers to recover damages, plus other relief the court deems just. She also seeks a judgment of no less than $50,000, plus attorney’s fees, punitive damages, costs and other relief the court deems just.
