Woman sues after tire bounces across interstate and into truck

A woman has filed suit against the driver of a vehicle that lost a tire and crashed into the truck in which she was riding.

Ginger Dewitt claims she was riding in a tractor-trailer William Dewitt was driving south on Interstate 294 near mile post 26.9 on Aug. 4, 2011. The suit does not indicate the city and state in which the incident occurred.

According to the complaint filed Sept. 27 in Madison County Circuit Court, a tire flew off the tractor defendant Stanislaw Szwajnos was driving north on the same road. The tire "bounced across I-294 into oncoming traffic," the suit states.

It struck the vehicle in which Ginger Dewitt was riding, causing her to sustain injuries, to incur medical costs and to experience pain and suffering, the complaint says.

Dewitt blames Szwajnos for causing the collision, saying he negligently hauled a tractor that was not in a roadworthy condition and failed to conduct adequate inspections of the vehicle.

Dewitt also names Szwajnos's employer, Baciar Construction, and Buske Lines, as defendants. Buske Lines negligently failed to evade a collision, according to the complaint.

Dewitt is seeking a judgment of more than $150,000, plus costs and other relief the court deems just.
