54th Street Grill worker claims improperly stacked boxes caused injuries

An Edwardsville restaurant employee says a food service company caused him to hurt his shoulder.

Thomas Gilbert filed a lawsuit Sept. 11 against Reinhart Foodservice LLC in Madison County Circuit Court.

Reinhart Foodservice delivered food products to 54th Street Grill on the 6000 block of Edwardsville Crossing in September 2010, according to the complaint. Someone with the company allegedly stacked boxes of the products in the walk-in #2 cooler of the restaurant. Gilbert, who worked at the 54th Street Grill, says when he walked into the cooler one of the boxes fell and caused him to hurt his right shoulder.

Gilbert accuses Reinhart Foodservice of negligence for allegedly stacking the boxes in an unsafe manner. He seeks more than $50,000 in damages for medical expenses, loss of income and court costs.

Gilbert is represented by attorneys Thomas E. Schwartz and Justin D. Guerra of St. Louis. They ask for a jury trial.
