Route 157 accident near SIUE is subject of suit

A man claims he suffered severe injuries after a driver struck his vehicle while attempting to make a left-hand turn.

Timothy J. Kluthe filed a lawsuit Sept. 7 in Madison County Circuit Court against Zachary M. Damm.

Kluthe claims he drove a 2001 Toyota Camry north on Illinois State Route 157 and was approaching the SIUE South Access Road when Damm, who was driving a 2003 Ford F350 Series south on the same road, attempted to turn left. Suddenly, Damm struck Kluthe's vehicle, according to the complaint.

Because of the collision, Kluthe suffered great pain and anguish and incurred substantial medical costs, the suit states.

Kluthe blames Damm for causing the collision, saying he negligently failed to stop at a traffic control device, failed to yield to the plaintiff, failed to stop in time to avoid a collision, failed to keep a proper lookout and failed to reduce his speed to avoid a collision.

In his complaint, Kluthe is seeking a judgment of more than $50,000, plus costs.
