Colorado collection agency sues over trucking company debt

A St. Clair County man is being sued by a Colorado collection agency for allegedly failing to pay for the use of rental equipment.

CACH LLC filed a lawsuit Aug. 14 against James Quirin in St. Clair County Circuit Court.

C. Grantham Company was a Madison County trucking company that was involuntarily dissolved in April 2010 by the Secretary of State, according to the complaint. At that time the company was under a lease contract with VFS Leasing Company for several pieces of equipment, with Quirin listed as the personal guarantor of the debt. Grantham allegedly failed to make the payments when they were due and still owes more than $201,000.

VFS Leasing says it assigned the contract to CACH to collect the debt but claims Grantham and Quirin have yet to pay the balance. CACH accuses Quirin of breach of contract and asks to be awarded the more than $201,000 it is owed plus attorney's fees and court costs.

The collection company is represented by attorney Richard P. Sulkowski of Chicago's Weltman, Weinberg & Reis law firm.
