Ag cooperative sues transportation company over $92K debt

An agricultural cooperative has filed suit against the transportation company that it claims failed to repay it more than $90,000.

M&M Service Company claims it entered into an agreement with Rochester Transportation in which Rochester purchased merchandise from M&M between Aug. 5, 2010, to present. It agreed to repay M&M within 30 days of receiving the merchandise, according to the complaint filed Sept. 6 in Madison County Circuit Court. However, it has failed to do so, the suit states.

"Despite repeated demand by plaintiff, defendant has failed to pay the balance due on its account, to-wit: $92,365.65, plus interest accruing after August 25, 2012, and costs of collection, including reasonable attorney fees," the suit states.

In addition to the money it says Rochester Transportation owes it, M&M Service Company is seeking pre-judgment interest, costs, attorney's fees and other relief the court deems just.

David L. Antognoli of Goldenberg, Heller, Antognoli and Rowland in Edwardsville will be representing it.
