Alton school bus rider sues over 2010 accident

Campbell

One of the riders in an Alton school bus has filed suit against the bus driver after he says the driver got into a collision with another driver.

Airwin D. Poole Jr. claims he was riding in a school bus defendant Nancy E. Brandenburg was driving east, exiting the Alton High School campus, on Aug. 27, 2010. As Brandenburg attempted to make a left-hand turn onto Humbert Road, she collided with the left side of another vehicle, according to the complaint filed Aug. 27 in Madison County Circuit Court.

Because of the collision, Poole sustained serious and permanent injuries, experienced pain and suffering, endured disability and incurred medical costs, the suit states. He also lost earnings, the complaint says.

Poole blames Brandenburg for causing the collision, saying she negligently drove in an improper manner, drove too fast, disregarded traffic signals, failed to keep a proper lookout, failed to keep the bus under control, failed to keep the steering of the bus in the proper order, failed to steer the bus to avoid a collision and failed to keep the bus's brakes in proper working order, among other negligent acts.

In addition to Brandenburg, Poole names Illinois Central Truck Leasing, Central Truck Leasing II and Central School Bus as defendants, saying Brandenburg was their employee at the time of the collision.

In his four-count complaint, Poole is seeking a judgment of more than $200,000, plus costs.

Timothy F. Campbell of Campbell and McGrady in Godfrey will be representing him.

Madison County Circuit Court case number: 12-L-1374.
