Alleged hit and run driver sued over O'Fallon accident

An Illinois man has filed suit against the driver who he claims turned into his lane of traffic, causing a collision.

Dolan M. McKelvy claims he was driving west on Highway 50 in O'Fallon near its intersection with West State Street on Aug. 10, 2010, when defendant Alice K. Mueller, who was driving east on the same road, attempted to turn left and struck Mueller. Following the collision, Mueller fled the scene of the accident, according to the complaint filed Aug. 1 in St. Clair County Circuit Court.

Because of the collision, McKelvy incurred medical costs and sustained severe and permanent injuries to his neck, shoulders, head and left foot, the suit states.

Mueller negligently failed to maintain a careful lookout, failed to observe McKelvy's vehicle, failed to drive in the proper lane, failed to drive while making a left-hand turn, crossed two lanes of traffic when attempting to make a left-hand turn and crossed into McKelvy's path of travel, among other negligent acts, the complaint says.

In her two-count complaint, McKelvy is seeking a judgment of more than $100,000, plus costs.

She will be represented by John G. Simon and Kevin M. Carnie Jr. of The Simon Law Firm in St. Louis.
