Jefferson County woman claims insurer failed to fully compensate for auto accident

A Jefferson County woman claims she was thrown about in her car after a driver failed to yield the right-of-way at an intersection and crashed into her automobile.

Keeondra Brown filed a lawsuit Aug. 9 in St. Clair County Circuit Court against American Standard Insurance Company of Wisconsin and Jorge Gonzalez.

In her complaint, Brown claims she drove a 2004 Saturn Vue south on Salem Road approaching its intersection with Oakland in Mount Vernon on Sept. 28, 2010, when Gonzalez, who drove north on Salem, attempted to make a left-hand turn and struck her vehicle.

Because of the collision, Brown incurred more than $14,000 worth of injuries; experienced great pain, suffering, disability and disfigurement; and lost her enjoyment of life, according to the complaint.

She blames Gonzalez for causing the collision, saying he negligently failed to yield the right-of-way, failed to stop or swerve to avoid a collision, failed to keep a proper lookout and drove too fast.

At the time of the collision, Gonzalez had no automobile insurance, the suit states. In turn, Brown had to make a claim with her insurance provider, American Standard Insurance Company, the complaint says. However, American Standard Insurance Company refuses to fully compensate Brown for her claim, she alleges.

"At a minimum, defendant American Family was required to tender payment to plaintiff of its low $12,000 offer of settlement and $5,000 of medical pay, and agree to negotiate or litigate the remaining amounts due," the suit states. "Defendant American Family failed to do so."

In her three-count complaint, Brown seeks a judgment of more than $160,000, plus attorney's fees, pre-judgment interest, costs and other relief the court deems just.
