A St. Clair County truck rental company says it is owed nearly $80,000 in unpaid lease payments.
Ryder Truck Rental Inc., doing business as Ryder Transportation Services, filed a lawsuit Aug. 8 in St. Clair County Circuit Court against B.N.E. Pallet Recycling Corporation, also known as BNE Pallet Recycling Corp.
According to the complaint, Ryder Truck Rental leased a truck to BNE in January 2011 with a contract stating payments were to be made on a regular basis. Ryder claims BNE failed to make all the payments as required. In April, BNE allegedly defaulted on its lease. Ryder Truck Rental contends the outstanding balance on the account was more than $52,000. Per the lease, Ryder says it demanded that BNE purchase the truck at a price of almost $78,000 but says the pallet company refused.
Ryder says it was forced to repossess the vehicle, incurring costs of more than $26,000. The truck rental company says it terminated the lease with BNE in May. Ryder is suing BNE for breach of contract and asks for more than $100,000 in damages, attorney's fees and court costs.
