Head-on collision in White County leads to Madison County suit

A woman has filed suit against the driver who she claims struck her vehicle head-on, causing her to be flown to a hospital, where she has spent months recovering.

Pamela P. Chamness claims she was driving south on Illinois Route 1 at its intersection with White County Road No. 800E in White County in southern Illinois on April 19. At the same time, Nicholas J. McKaig, who was driving in the opposite direction for defendant K. Ervin Wayne doing business as Allied Termite and Pest Control, failed to timely recognize that the vehicles in front of him were slowing down, according to the complaint filed Aug. 9 in Madison County Circuit Court.

"In an attempt to avoid colliding with the rear of the vehicles in front of him, (McKaig) negligently pulled out of his lane into the southbound lane and caused his vehicle to crash into the vehicle being operated by the plaintiff Chamness," the suit states.

At the scene of the collision, Chamness was taken by helicopter to the hospital, the complaint says.

Chamness blames McKaig for causing her collision, saying he negligently drove too fast, failed to decrease his speed as he approached an intersection and failed to keep a proper lookout.

In her complaint, Chamness seeks a judgment of more than $50,000.

She will be represented by John Womick of Womick Law Firm in Herrin.
