Woman files legal malpractice case over handling of '98 auto accident case

A woman has filed suit against the lawyer who she claims failed to file a claim on her behalf after she was struck by a vehicle more than 13 years ago.

Robin M. Duckett claims she was five years old on Feb. 26, 1998, when Angela D. McLauglin struck her.

Following the collision, Duckett's parents hired defendant G. Edward Moorman to represent her in court, according to the complaint filed July 23 in Madison County Circuit Court.

However, Moorman failed to prosecute the claim, and on Sept. 15, 2011, Duckett hired someone else to represent her in court, the suit states.

Because of Moorman's failure to timely file the lawsuit, Duckett was forced to settle for substantially less money than she would have made had she been able to prosecute in a timely manner, the complaint says.

Duckett blames Moorman for negligence, saying he failed to obtain the identities of all physicians who treated her, failed to obtain all medical records, failed to identify and notify defendants, failed to keep her parents appraised as to her status and failed to prosecute her claim in a timely manner.

In her complaint, Duckett is seeking a judgment of more than $50,000, plus costs.
