CMC set in couple's case against bar owners

Madison County Circuit Judge David Hylla on July 25 set a status conference in a case involving two Alton bars accused of over serving alcohol to a woman who allegedly got behind the wheel after drinking and crashed into a motorcyclist.

The status conference is Oct. 24.

Robert and Jennifer Branham filed a lawsuit last October in Madison County Circuit Court against Tony's Lounge Inc. and Chez Marilyn Inc.

According to the complaint, Kathryn Gray was a patron of Tony's Lounge on Piasa Street and Chez Marilyn on West Third Street in October 2010.

The couple says Gray was served alcoholic beverages at both lounges.
The Branhams say Gray then left the bars, got behind the wheel of her car and crashed into Robert Branham as he was riding his motorcycle.

The Branhams accuse the two Alton bars of violating Illinois' Dramshop Act and seek more than $50,000 in damages for medical expenses, loss of income and court fees.

Attorney Michael R. Wesley of Wood River is representing the Branhams.
Greg Gaz of Springfield represents Chez Marilyn.

John Cunningham of Brown & James in Belleville represents Tony's Lounge.
