Chateau Township blamed for accident over lack of stop sign

A Madison County woman says the Township of Chateau is to blame for a crash at a Pontoon Beach intersection.

Marie McClery filed a lawsuit July 19 in Madison County Circuit Court against Randy Ray Hartman, Sperry Rail Service and the Township of Chateau.

McClery says she was driving east on Engineer Road in August 2011. As she entered the intersection of Chateau Trace, McClery says Hartman, driving south on Chateau Trace, failed to stop and crashed into the side of her vehicle. Hartman was allegedly driving a Sperry Rail Service truck at the time of the crash.

McClery also claims there was no stop sign on the north side of the intersection, which she contends is why Hartman drove into the intersection without stopping. She alleges Chateau Township either didn't put in a stop sign originally or didn't replace one that had been removed or knocked down.

McClery says her back and neck were hurt in the crash. She accuses the city, Hartman and his employer of negligence. She asks for more than $60,000 in damages to pay for medical bills, loss of income and court fees.
