Both parties in a man's personal injury lawsuit against his Alton apartment owner agreed to dismiss the case July 19 in Madison County Circuit Judge Dennis Ruth's courtroom.
Isaacs Machado alleged that a piece of ceiling fell on his head while he was sitting in his kitchen at his apartment at 1118 East Seventh St.
About two months before the alleged incident, Machado had informed the apartment's owners, defendant Hellrung Properties, that the kitchen ceiling in his apartment was falling apart.
In addition to his head and neck injuries, Machado claimed he incurred medical costs and had been unable to perform normal activities, his complaint stated.
Machado blamed Hellrung for allowing the incident to occur, alleging it failed to inspect the property and failed to maintain the ceiling in the kitchen.
Machado had sought a judgment of more than $50,000.
