Walgreens worker sues maintenance company over slip on wet floor

A Troy woman claims she sustained low back, right knee and right hip injuries after falling on a wet floor at Walgreens.

Cheri DeCarlo filed a lawsuit July 12 in Madison County Circuit Court against Paul Hesse doing business as J & W Janitorial Services.

In her complaint, DeCarlo alleges she was working for Walgreens at its Maryville location on Aug. 19, 2010, when she slipped on a wet floor.

Hesse had been hired as maintenance for Walgreens and had recently mopped the floor, but had failed to place a wet floor sign on it, according to the complaint.

In addition to her injuries, DeCarlo suffered disability and disfigurement, experienced pain and suffering, incurred medical costs and lost wages because of her fall, the suit states.

Hesse negligently failed to place a wet floor sign in the area where they were mopping floors and failed to warn employees of any dangerous conditions, the complaint says.

In her two-count complaint, DeCarlo is seeking a judgment of more than $100,000, plus costs and other relief the court deems just.

Jason R. Caraway of Kolker Law Offices in Belleville will be representing her.

Madison County Circuit Court case number: 12-L-991.
