Customer injured while opening door for others sues Highland McDonald's

The owner of a Highland fast food restaurant is being sued by a customer who says she broke her leg.

Tina Kutzgar filed a lawsuit June 22 in Madison County Circuit Court against C-Mac Inc, the company that owns the McDonald's in Highland.

Kutzgar says she was visiting the McDonald's on Suppiger Lane in June 2010. She says she opened the door to enter the restaurant at the same time as other customers were walking out. Kutzgar says she stepped backward to hold open the door when her foot allegedly landed on an area of uneven concrete. Kutzgar claims the uneven surface caused her to fracture the lower part of her fibula.

Kutzgar accuses C-Mac of negligence for allegedly not keeping its property safe for customers. She asks for more than $50,000 in damages for medical bills and loss of income along with the cost of the lawsuit.

Attorney John C. Webster of Alton represents Kutzgar.
