Two Granite City residents have filed suit against the driver who they claim side-swiped a truck, causing them to sustain injuries.
Theresa and Stacy Barton claim they were riding in a car defendant Sharon Rhodes was driving on the entrance ramp to I-270 eastbound from Route 203 in Granite City on Dec. 15 when the collision occurred.
"While attempting to merge to the left, Defendant Rhodes crashed into the side of a tractor trailer truck," the suit states. "Rhodes's vehicle spun around and hit a guard rail."
At the time of the accident, Theresa Barton was sitting in the back seat while Stacy Barton was in the front passenger seat, according to the complaint filed June 13 in Madison County Circuit Court.
Because of the collision, Theresa and Stacy Barton sustained back and neck injuries, incurred medical costs and experienced pain and suffering, the suit states.
Rhodes negligently failed to keep a proper lookout, failed to yield the right-of-way, failed to drive in a safe manner and failed to stop or swerve to avoid a collision, the complaint says.
In their two-count complaint, the Bartons are seeking an unspecified judgment, plus other relief the court deems just.
Gary K. Burger of Cantor and Burger in St. Louis will be representing them.
