Opening arguments to start Tuesday in auto-pedestrian accident trial

Opening arguments will begin Tuesday in a Madison County trial involving a pedestrian who was struck by a car while crossing Route 159.

Circuit Judge Dave Hylla presides.

Marylynn S. Dixon is seeking in excess of $50,000 in damages from defendant William D. Maggart, who was driving north on Route 159 at the time of the incident, according to the suit filed in 2009.

Dixon claims she suffered injuries to her knees, face and eyes, experienced past and future pain, suffering and disability and incurred medical costs.

Maggart negligently failed to reduce his speed to avoid a collision, drove too fast for road conditions and failed to keep a proper lookout for pedestrians, Dixon alleges.

Dixon is represented by attorney Keith Short of Shiloh.

Maggart is represented by Steven Mudge of Edwardsville.

The trial is expected to last less than a week.
