BMO Harris seeks enforcement of foreign judgment in Madison County

A bank is asking an Edwardsville development company be held accountable for a $211,000 judgement filed against it earlier this year in St. Louis County Circuit Court.

BMO Harris Bank N.A. filed a lawsuit May 18 in Madison County Circuit Court against Summit Development & Holdings Inc. and Thomas B. Baker.

Attached to the complaint is a copy of a judgement filed March 30 in St. Louis County Circuit Court ordering Summit Development and Baker to pay BMO $174,456 plus more than $40,000 in interest and fees. According to that summary judgement, the defendants never answered any motions and failed to appear in court for the hearing.

Judge Maura B. McShane ordered Summit and Baker to pay BMO Harris Bank the full principal along with nearly $18,940 in court costs along with interest in the amount of $18,475. The defendants were ordered to pay additional interest of $36.15 per day as long as the debt is outstanding.

In the complaint filed May 18, BMO Harris claims it has not received any payment from the defendants. The bank requests that the original summary judgement be registered in Madison County Circuit Court and that the judgement be "given full faith and credit in the State of Illinois."
